Use the Services for any unlawful, fraudulent, or prohibited purpose, or in violation of any applicable law or regulation;
Copy, reproduce, modify, adapt, translate, publish, publicly display, broadcast, transmit, distribute, sell, license, or otherwise exploit any part of the Services except as expressly authorized;
Reverse engineer, decompile, disassemble, decode, or attempt to derive source code or trade secrets, except to the limited extent required by applicable law;
Circumvent, attempt to disable or render ineffective, or otherwise interfere with any security or access control measure employed by Apicat;
Harvest, scrape, index, or mine data from the Services by automated or manual means, other than as explicitly permitted by Apicat’s documented APIs and at volumes consistent with normal Service usage;
Use the Services in a manner that degrades or impairs the Service’s integrity or availability, such as denial-of-service attacks, excessive automated requests, or introducing malicious code;
Upload, transmit, or otherwise make available any content that is harmful, harassing, abusive, defamatory, obscene, pornographic, hateful, violent, threatening, discriminatory, infringing, deceptive, or otherwise objectionable;
Misrepresent your identity, impersonate any person or entity, or misstate your affiliation with any person or entity;
Use the Services to violate export control, embargo, or sanctions laws, or to engage with any person or entity listed with the U.S. Office of Foreign Assets Control, the European Union’s sanctions lists, or similar authorities;
Resell, rent, lease, sublicense, time-share, host, or otherwise make the Services available to third parties, except with Apicat’s prior written consent.
Such content may be indexed by search engines, copied or forked by others, and remains publicly accessible until all copies are deleted by their respective owners.
Removals are not always immediate or guaranteed if forked.
Other users may create derivative works, and your license to Apicat (and others) for such copies persists until all are deleted.
Data as defined by GDPR Article 9 (e.g., racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic/biometric data, health data, sex life/sexual orientation);
Protected health information (as defined by HIPAA or similar);
Financial/payment card data subject to PCI DSS;
Government-issued IDs or similar data types.
Use Apicat, or any User Content or Service data, for training artificial intelligence, machine learning models, data scraping/mining, or similar automation except as expressly permitted in a written agreement.
Use Service-derived data to build, train, or enhance third-party AI, bots, or similar automated tools.
Not to use the Services in any manner that could damage, disable, interfere with, or impair Apicat’s systems, servers, or networks;
Not to access or attempt to access accounts, data, or systems you do not have explicit permission to access;
Not to transmit viruses, worms, malware, or any other malicious software code;
Not to upload or transmit unlawful, defamatory, libelous, infringing, obscene, or otherwise objectionable material;
Not to engage in spamming, chain letters, pyramid schemes, or unsolicited advertising;
Not to use automated means (including robots, spiders, scripts, or the like) to access or interact with the Services in violation of Apicat’s published API guidelines or rate limits;
Not to use the Services to develop competing products or services unless expressly allowed under an applicable open source license or with express written consent from Apicat.
Your account and associated data (except as required to be retained under applicable law or policy) will be deleted within 30 days.
Service access will cease; Apicat will not be responsible for retrieving, migrating, or restoring data after deletion.
You will not be entitled to any refunds for prepaid fees except as required by law or express offer.
Your right to access or use the Services ceases immediately;
Fees or charges incurred up to the effective date remain due and payable;
Data deletion will proceed per our data retention practices;
Sections pertaining to intellectual property, indemnification, limitation of liability, dispute resolution, and other terms which by their nature ought to survive termination will remain in effect.
For users in the EEA/UK: Apicat will provide at least 30 days' advance notice (by email, in-app notification, or other reasonable means). Continued use after changes take effect constitutes acceptance. You may reject changes by notifying Apicat in writing before effective date; your remedy is to discontinue use and, if applicable, terminate your subscription (pro-rated refunds provided only as required by law).
Users elsewhere: Changes become effective upon posting or notification. Continued use after effective date = acceptance.
Arbitration shall be conducted by a single arbitrator.
Arbitration is individual; you agree not to bring claims as a plaintiff or class member in any purported class, collective, or representative proceeding.
Judgement upon the arbitral award may be entered in any court of competent jurisdiction.
Either party may seek temporary or preliminary injunctive relief in a court of competent jurisdiction for intellectual property or security issues.
Entire Agreement: These Terms (together with incorporated policies and any applicable service agreements or addenda) constitute the full legal agreement between you and Apicat and supersede all prior or contemporaneous oral or written agreements on this subject matter.
Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision will be limited to the minimum extent necessary and the remaining provisions will remain in full force.
Waiver: No failure or delay by Apicat to exercise any right or enforce any provision or remedy under these Terms shall constitute a waiver of that or any other right.
Assignment: You may not transfer, assign, or delegate these Terms, in whole or part, or any right or obligation hereunder, without Apicat’s prior written consent. Apicat may assign or transfer these Terms freely.
Force Majeure: Apicat will not be liable for any failure or delay in the performance of its obligations due to any event beyond Apicat’s reasonable control, including but not limited to war, natural disasters, strikes, internet or power outages.
Notices: All notices from you must be sent in writing to legal@apicat.com or to our current mailing address listed on our website. Legal notices to you may be given by email, in-app notification, or postal mail to your registered account address. API/Rate Limits: Use of Apicat’s public or private APIs is governed by published documentation and subject to strict rate limits and resource usage thresholds. Abuse (including attempts to bypass, “scrape”, or attack APIs) will result in warnings, account suspension, or termination as appropriate.
Deprecation/Modification: Apicat may modify, deprecate, or discontinue APIs/features with reasonable notice, especially for critical changes or security issues.
Enforcement: Apicat reserves the right to immediately restrict access in case of malicious or abusive use.
